Smart people that mod their consoles do not play online.
This is the only reason I have not modded mine. I enjoy playing online too much to get it banned.

They might have done a round of bans, but, everyone I know with a modded 360 are still playing online. If you do it right and are smart about getting the games, it's pretty hard to get caught.
If you do happen to get caught, they ban only your actual console (not hard drive or even Live account). So you can still play any single player game that ever comes out for free or even grab a broken 360 off e-bay/craigslist for $50, fix, mod it and bam you're back in business.
I got a broken arcade for $50 that was still under warranty, got MS to fix it and now the kids play it (and leave mine alone). I've bought a few more to fix and sell... still have one that's being a pain. Been thinking about modding mine for a while...

apparently they also have been doing live bans as well... i been hearing that each time they do a dashboard update they incorporate small little patches that sniff out unauthorized parts. I dunno I wouldn't do it myself, I would mod and play offline but never online with em unless I had mad disposable income.

My elite is too precious to me to risk getting it banned. I've also still have several games (Assasin's Creed, Mass Effect, Fable 2) that I haven't even put into my console to play yet so it'll be a long while before I'm looking to buy a new game.

Yes, my modded console is now banned. For the first time in like 4 years they finally found a way to tell if you are running non-stock firmware, so as usual people with modded consoles updated and thought they were safe since the update didn't ban them. Then later, like myself, were banned because the new update gave indisputable info to MS to ban us.
The only thing that bothers me is the stuff with the HD, I have a self made 120gb which is actually a 250gb drive flashed as a 120gb and I was going to up it to a 250gb drive as soon as the MW2 edition systems came out. Apparently I can't ever install a game to my HD now that is has been banned, so there is no use in having the HD unless I buy a mod chip or something to actually play off the HD without a disc. I guess I'll just use a 256mb mem unit for my save games and just play single player stuff, besides the initial amount of online play I did with NHL 09/10 I wasn't really playing on live that much recently.
Also, my xbox elite was a broken elite that I fixed, the unit itself only cost me $38 which is why I modded it in the first place. I think it's interesting the way MS can estimate the sales they lost from modded consoles, I personally only got a 360 because I could mod it. No single player game that is over in like 15-25 hours is worth paying $60 for, fuck that.

Good multiplayer is the best way to enforce anti-piracy because when you have to connect online to play it opens up so many more options for detection. Also, I usually don't think games are worth the money because without a good multiplayer mode the replay value is so much less for me. I was just playing some TF 2 yesterday and I noticed I had over 250hrs played, Medic and Engineer were my 2 most played classes with over 50 hrs each.
